NOTICE OF PUBLIC HEARING BARRETT TOWNSHIP ZONING HEARING BOARD The Barrett Township Zoning Hearing Board will conduct a public hearing at the Barrett Township Municipal Building, 1200 Route 390, Cresco, PA 18326 on April 24, 2025, at 6:30 p.m. to hear the application of Jason Delp for a variance for property located at 372 Lake Road, Canadensis, Pennsylvania, 18325, bearing a tax parcel number 1/6/1/3.
The property is located in an R Zone and is 1.5 acres. Applicants presently maintain three (3) goats, five (5) chickens and seven (7) guinea hens in a barn and fenced area on the property. Applicants maintenance of the above described animals constitute keeping of livestock under § 525-23.H(8) of the Zoning Ordinance.
Applicants seek the following variances:
(A) Allowance of a lot of 1.5 acres, where the Ordinance requires two (2) acres for the keeping of livestock § 525-23.H(8)(b).
(B) Variance to keep livestock in excess of what the Ordinance defines as a “animal unit” in § 525-3.B, an animal unit being described as six (6) goats or twenty (20) poultry, rabbits or hares.
(C) Allowance of an existing barn on the property twenty-five (25) feet from the lot line and right-of-way lines, instead of the required fifty (50) foot setback as set forth in § 525-23.H(8)(e).
(D) Relief from the requirement of submitting a manure management plan which is required by § 525-23.H(8)(j).
Applicants also seek interpretation by the Zoning Hearing Board of Ordinance § 525-23.A (1) that the keeping of livestock on Applicants' property does not constitute an agricultural and horticultural use, as Applicants are not raising livestock as part of any agricultural enterprise.
In the event that the Board determines that Applicants' use constitutes agriculture and horticulture, then Applicants seek the following additional variances:
(A) Allowance of the existing barn on the property twenty-five (25) feet from the lot lines and right-of-way lines instead of the required one-hundred (100) feet as required by § 525-23.A(1)(a). In the event that the Board would deny this request Applicant seeks relief to allow new barn to be located on the property as shown on a plan attached to the Application. The proposed new location may be less than one-hundred (100) feet from the subject lot lines.
(B) Variance to allow the keeping of livestock and poultry on the property on a lot of 1.5 acres instead of allotted five (5) acres with respect to the keeping of three (3) goats, five (5) chickens and seven (7) guinea hens instead of two (2) heads of livestock or horses or twenty-five (25) foul per acre as described in § 525-23.A(1)(c)(1).
(C) Relief from the requirement of the Ordinance of submitting a plan addressing liquid and solid waste disposal in § 525-23.A(1)(d).
